Cade signs agreements in cartel investigations in the automobile sector


The Court of the Administrative Council for Economic Defense (Cade) signed agreements, on Wednesday (19/6), in two investigations in the automobile sector. Cessation Commitment Terms (TCCs) were approved with two companies and seven individuals, which will result in the collection of approximately R$71 million in pecuniary contributions.

One of the administrative proceedings investigates cartel practices in the national market for exhaust systems and their automobile components. According to investigations, three companies fixed prices and commercial conditions, divided markets and exchanged commercially and competitively sensitive information.

The conduct occurred in the context of B2B Lead purchase orders from automakers or in the context of price adjustments demanded by the suppliers themselves, as well as in an attempt to divide the supply of exhaust systems and their components sold to the automakers on a percentage basis.

Under the signed TCC, the company Magneti Marelli Sistemas Automotivos Indústria e Comércio undertakes to pay R$ 36,816,982.14 as a pecuniary contribution. Three individuals, in turn, will collect approximately R$ 786.3 thousand from the Fund for the Defense of Diffuse Rights (FDD).

Other agreements
This is the third agreement signed within the scope of the administrative process that investigates cartel practice. The company Faurecia Automotive do Brasil and two individuals have already signed agreements, with a total payment of R$ 15.7 million to the FDD.

Another TCC approved by the court was signed in a cartel investigation in the independent automotive replacement parts market. According to the investigations, companies operating in the sector would have shared commercially and competitively sensitive information. The objective would be to create parameters to delimit decision-making processes related, for example, to the transfer of cost increases in the prices charged for products on the market.

The exchange of information allowed companies to predict aspects such as prices, sales and production levels and each other's business strategies to, in this way, structure coordinated and strategic action between them, with the effect of harming or limiting competition in the independent market. replacement auto parts.
